By accessing or using CoreStack, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing, downloading, installing, or using CoreStack software, products, or services (collectively, "CoreStack," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you are expressly prohibited from using our services and must immediately cease all access to CoreStack.

IMPORTANT: These Terms contain binding arbitration and class action waiver provisions that affect your legal rights. By agreeing to these Terms, you waive your right to participate in class action lawsuits or class-wide arbitrations.

CoreStack reserves the right to modify, amend, or update these Terms at any time, with or without notice. Your continued use of CoreStack following any changes constitutes your acceptance of such changes. It is your sole responsibility to periodically review these Terms for updates.

2. Eligibility and Age Restriction

You represent and warrant that you are at least eighteen (18) years of age or the age of majority in your jurisdiction. CoreStack is not intended for individuals under the age of eighteen (18). If you are under eighteen (18), you are not permitted to use our services under any circumstances.

By using CoreStack, you further represent and warrant that:

  • You have the full power and authority to enter into this binding agreement;
  • You are not located in a country that is subject to a U.S. government embargo or that has been designated as a "terrorist-supporting" nation;
  • You are not listed on any U.S. government list of prohibited or restricted parties;
  • You are not using CoreStack in violation of any applicable laws or regulations in your jurisdiction.

3. Strict No Refund Policy

ABSOLUTELY NO REFUNDS – YOU ARE NOT ENTITLED TO A REFUND UNDER ANY CIRCUMSTANCES.

ALL SALES ARE FINAL. COREStack OPERATES A STRICT, UNCONDITIONAL, AND IRREVOCABLE NO-REFUND POLICY. By completing your purchase, you acknowledge and agree that CoreStack shall not be required to issue a refund to you for any reason whatsoever, including but not limited to:

  • Change of mind or buyer's remorse;
  • Game updates or patches that temporarily affect functionality;
  • Anti-cheat detections or account bans;
  • Hardware or software incompatibility;
  • Failure to read product descriptions or system requirements;
  • Inability to use the product due to any reason;
  • Dissatisfaction with product features or performance;
  • Duplicate purchases or accidental purchases;
  • Any other reason, whether foreseeable or unforeseeable.

You expressly waive any right to seek chargebacks, refunds, or reversals from your financial institution, payment processor (including Stripe, PayPal, or cryptocurrency processors), or any third party. Any disputed charges or chargebacks initiated against CoreStack will result in immediate and permanent termination of your account, forfeiture of all access rights, and you shall remain fully liable for the original purchase amount plus all administrative fees and collection costs incurred by CoreStack.

4. No Warranty; "AS-IS" Provision

CORESTACK SOFTWARE AND SERVICES ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, CoreStack expressly disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;
  • Warranties that the software will be uninterrupted, error-free, secure, or free from viruses or other harmful components;
  • Warranties regarding the accuracy, reliability, or completeness of any information provided;
  • Warranties that the software will remain undetected by third-party anti-cheat systems;
  • Warranties that your accounts will not be suspended, banned, or terminated by game publishers.

You acknowledge and agree that CoreStack is gaming enhancement software that operates in a legally ambiguous environment. Game publishers and anti-cheat providers actively seek to detect and block software such as CoreStack. YOU ASSUME ALL RISKS ASSOCIATED WITH THE USE OF CORESTACK, INCLUDING BUT NOT LIMITED TO ACCOUNT SUSPENSIONS, PERMANENT BANS, HARDWARE ID BANS, IP BANS, AND LEGAL ACTION FROM THIRD PARTIES.

5. Assumption of Risk and Liability Waiver

YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH THE USE OF CORESTACK. CoreStack is designed to modify and interact with third-party software in ways that may violate the terms of service of those third parties. Game publishers, including but not limited to Epic Games, Riot Games, Activision Blizzard, and Valve Corporation, actively prohibit the use of third-party enhancement software.

YOU WAIVE AND RELEASE CORESTACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SUCCESSORS FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING FROM OR RELATED TO:

  • Temporary or permanent account suspensions or bans;
  • Hardware ID (HWID) bans, IP bans, or device fingerprinting bans;
  • Loss of virtual items, in-game currency, progress, or purchases;
  • Legal threats or actions initiated by game publishers or anti-cheat providers;
  • Financial losses, lost profits, or business interruption;
  • Damage to reputation or personal standing;
  • Any other direct, indirect, incidental, special, consequential, or punitive damages.

This waiver applies even if CoreStack has been advised of the possibility of such damages and regardless of the legal theory (contract, tort, strict liability, or otherwise) upon which any claim is based.

6. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS CORESTACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES, FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES AND LEGAL COSTS) ARISING FROM OR RELATED TO:

  • Your use of or inability to use CoreStack software or services;
  • Your violation of these Terms;
  • Your violation of any third-party rights, including but not limited to intellectual property rights, contractual rights, or terms of service;
  • Your violation of any applicable laws or regulations;
  • Any claims or actions brought against CoreStack by game publishers, anti-cheat providers, or other third parties arising from your use of our software;
  • Any disputes, claims, or actions arising from account bans, suspensions, or terminations related to your use of CoreStack.

CoreStack reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with CoreStack's defense of such claims. You agree not to settle any such matter without CoreStack's prior written consent.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CORESTACK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or anticipated savings;
  • Loss of goodwill, reputation, or business opportunity;
  • Loss of data, accounts, or virtual property;
  • Account bans, suspensions, or terminations;
  • Hardware damage or system failures;
  • Any other pecuniary or non-pecuniary loss.

IN NO EVENT SHALL CORESTACK'S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU PAID TO CORESTACK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50.00 USD, WHICHEVER IS LESS. This limitation of liability shall apply regardless of the legal theory (contract, tort, strict liability, or otherwise) upon which any claim is based, even if CoreStack has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you to the extent prohibited by applicable law.

8. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY – IT AFFECTS YOUR LEGAL RIGHTS AND WAIVES YOUR RIGHT TO SUE IN COURT OR PARTICIPATE IN A CLASS ACTION.

8.1 Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of CoreStack services shall be resolved exclusively by binding, confidential arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the English language in Delaware, United States, unless you and CoreStack agree otherwise. The arbitrator's decision shall be final and binding and may be entered in any court having jurisdiction.

8.2 Class Action Waiver. YOU AND CORESTACK AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES SHALL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING AGAINST CORESTACK.

8.3 Jury Trial Waiver. YOU AND CORESTACK WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY.

8.4 Small Claims Court Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court in Delaware if the action is within that court's jurisdiction and is not brought as a class or representative action.

9. Prohibited Conduct and Account Termination

9.1 Prohibited Conduct. You agree not to:

  • Resell, redistribute, sublicense, lease, lend, or otherwise transfer your CoreStack license or access credentials to any third party;
  • Share your account credentials, license keys, or loader access with any unauthorized user;
  • Attempt to reverse engineer, decompile, disassemble, or derive the source code of CoreStack software;
  • Modify, adapt, or create derivative works based on CoreStack software;
  • Circumvent or attempt to circumvent any license enforcement mechanisms, authentication systems, or security features;
  • Use CoreStack software in any manner that violates applicable laws or regulations;
  • Harass, threaten, or abuse CoreStack staff or other users;
  • Initiate chargebacks, payment disputes, or fraudulent refund claims;
  • Upload or distribute malicious code, viruses, or harmful software through CoreStack platforms.

9.2 Account Termination. CoreStack reserves the right, in its sole discretion and without prior notice, to suspend, disable, or permanently terminate your account and access to CoreStack services for any reason, including but not limited to:

  • Violation of these Terms;
  • Suspected fraud, chargebacks, or payment disputes;
  • Suspected account sharing or unauthorized distribution of access credentials;
  • Any conduct that CoreStack deems harmful to its business, reputation, or user community.

9.3 No Refund Upon Termination. In the event of account termination for any reason, you are not entitled to any refund, prorated or otherwise, for any unused portion of your license. All fees paid are non-refundable as provided in Section 3.

10. Intellectual Property Rights

10.1 Ownership. CoreStack software, including all source code, object code, algorithms, designs, graphics, user interfaces, audio, video, and other content, is the exclusive property of CoreStack and its licensors and is protected by United States and international copyright, trademark, patent, and trade secret laws.

10.2 License Grant. Subject to your compliance with these Terms, CoreStack grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use CoreStack software solely for your personal, non-commercial use. This license is expressly conditioned upon your strict adherence to these Terms.

10.3 License Revocation. CoreStack reserves the right to revoke your license at any time, with or without cause, with or without notice. Upon revocation, you must immediately cease all use of CoreStack software and permanently delete all copies in your possession.

10.4 Restrictions. You acknowledge that CoreStack software contains valuable trade secrets and proprietary information. You agree not to disclose, reverse engineer, or attempt to derive the source code of CoreStack software for any purpose.

11. Privacy and Data Collection

Your use of CoreStack is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using CoreStack, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

You acknowledge that CoreStack collects and processes certain information, including but not limited to:

  • Hardware identifiers (HWID), MAC addresses, and system specifications;
  • IP addresses and geolocation data;
  • Usage data, including software interactions and feature utilization;
  • Account credentials and payment information (processed through third-party payment processors).

12. Third-Party Services and Links

CoreStack may integrate with or link to third-party websites, services, or payment processors (including Stripe, PayPal, and cryptocurrency processors). CoreStack does not control, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that CoreStack shall not be liable for any damages or losses arising from your use of third-party services.

13. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

Subject to the arbitration provisions in Section 8, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum.

14. Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable under applicable law, such provision shall be limited or eliminated to the minimum extent necessary and shall not affect the validity and enforceability of any remaining provisions. The remaining provisions of these Terms shall remain in full force and effect.

15. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. CoreStack's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by CoreStack, constitute the entire and exclusive agreement between you and CoreStack regarding your use of CoreStack software and services, and supersede all prior oral or written agreements, understandings, or communications regarding the subject matter hereof.

BY CLICKING "I AGREE," "PURCHASE," "CHECKOUT," OR BY ACCESSING OR USING CORESTACK SOFTWARE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE LEGALLY BOUND BY THEM.

YOU AGREE THAT CORESTACK OPERATES A STRICT NO-REFUND POLICY, THAT YOU ASSUME ALL RISKS ASSOCIATED WITH THE USE OF OUR SOFTWARE, AND THAT YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS AGAINST CORESTACK.
